Honorable Ladies and Gentlemen:
The Albany Police Officers Union condemns and opposes the New York Secure Ammunition and Firearms Enforcement Act (the SAFE Act). Substantively, we believe that it violates fundamental constitutional rights, that it is unduly and purposely burdensome on law-abiding citizens, and” that it will not deter criminals or menially ill individuals from plotting and carrying out bloodshed and violence. Procedurally, we believe that the way in which the bill was rammed into law via an unjustified and expedient “message of necessity”, which circumvents the right and the ability of the citizens of this State to voice their concerns about the bill and have them addressed, is an outrage. This flawed law and the way in which it was rushed and passed, shows the apparent contempt that those who govern have for the governed, and calls into question whether we truly have a representational government. Morally, we believe that this law is about ideology and politics and not about making anyone any safer. We respectfully demand that you do the right thing and repeal the law.

That makes us criminals under the "background check" bill currently under consideration in the U.S. Senate. Sen. Charles Schumer, who proposed the measure, has packed his legislation full of legal snares virtually guaranteed to turn gun owners into lawbreakers. That's an impressive little sleight of hand for legislation considered to be the only sort of gun control with a chance to make it through Congress.

A state Supreme Court judge on Wednesday denied a motion for a preliminary injunction of the state's new gun-control law.
A group of more than 1,200 plaintiffs representing themselves sued the state on the grounds that Gov. Andrew Cuomo and the Legislature's process for passing the law on the first day of session violated the state constitution.

Albany, N.Y. (WKBW) - It is a big day in State Supreme Court, Wednesday. Opponents to New York's new gun law hope their argument will be enough to strike down the law. There were more than 1200 signatures collected from counties across the state questioning the SAFE Act. Now, it is heading to court.

Last Saturday when Chuck and I were at the gun show in Saratoga, Albany County District Attorney David Soares was attending a gun-control rally outside. I caught up with him and asked him what he was doing there, since it’s out of his district. The rally was supporting a ban on assault weapons and large capacity magazines. So I asked him straight up, how many of the cases his office prosecutes actually involve these so-called “assault weapons”. Here is what he told me:

Back in January, when Chuck and I attended the gun show in Saratoga Springs, we asked Albany County District Attorney David Soares why he was in attendance at the anti-gun rally outside. He told me that they see assault weapons and large capacity magazines used "quite often" in crimes in Albany County. However, a Freedom of Information Request proved that to be untrue.

ALBANY – Empire State Plaza became a sea of American flags, camouflage outer wear, and witty placards, when over 12,000 NRA supporters rallied Thursday afternoon outside the State Capitol in Albany.
They gathered to voice opposition to the New York Secure Ammunition and Firearms Enforcement Act of 2013, commonly known as the NY SAFE Act, which was passed in January in the wake of the Sandy Hook school massacre in Connecticut.
The law restricts all firearms in New York to magazines of seven bullets or less – making many law abiding gun owners into instant criminals with the stroke of a pen. Additionally, licensed handgun owners must now acquire a new permit every five years.

Comcast, which recently acquired NBC Universal, has quietly decided to remove advertisements promoting firearms from its cable network, and gun retailers aren’t happy about it.
A Michigan company that handles the advertising for Michigan-based Williams Gun Sight and Outfitters contacted TheBlaze regarding the change, stunned that it couldn’t re-air a commercial they played last fall due to the new policy.

Leading gun rights groups put New York State on notice for violating the U.S. and New York State Constitutions for passage and enforcement of the NYS SAFE Act 2013.
“On January 29, we served a Notice of Claim on the Attorney General of the State of New York,” said Brian Stapelton, partner at Goldberg Segalla LLP, an Albany law firm. “This is the jurisdictional prerequisite for filing a lawsuit against a municipal body.”

Police officers in Seattle, Washington held their first gun buyback program in 20 years this weekend, underneath interstate 5, and soon found that private gun collectors were working the large crowd as little makeshift gun shows began dotting the parking lot and sidewalks. Some even had “cash for guns” signs prominently displayed.

The United States Department of Homeland Security has stated a rifle chambered in 5.56 NATO (compatible with .223) with a magazine capacity of 30 rounds is “suitable for personal defense use in close quarters…”

On Jan. 9, Vice-President, and head of the Obama administration's task force on gun violence, Joe Biden, suggested that the President may invoke an Executive Order to limit the sale and ownership of guns in the wake of the Sandy Hook shooting. However, a little known provision passed by Congress, and signed by the President in regards to Obamacare, restricts the government from collecting any data on, or creating any databases for, guns or ammunition purchased by legal citizens.

As a young boy I was shot by a man whose clear intent was to kill me as I had deliberately, by throwing broken bricks at him, interrupted his attempt to rape a young teen-aged girl, allowing her to escape. To this day I can still see the evil in his face and the sun glistening off the barrel of the pistol he aimed in my direction. As I turned and began to run away he fired hitting me in back. The bullet entering my chest felt as if someone had hit me with baseball bat followed immediately by an excruciating burning sensation as I fell to the ground from the impact. Perhaps it was the adrenaline, but I was able scramble to my feet and run as far as I could until finally passing out from the shock and loss of blood. Fortunately, someone came to my rescue and took me to a military hospital and the first step on my journey to the United States.

I will not register my weapons should this bill be passed, as I do not believe it is the government’s right to know what I own. Nor do I think it prudent to tell you what I own so that it may be taken from me by a group of people who enjoy armed protection yet decry me having the same a crime. You ma’am have overstepped a line that is not your domain. I am a Marine Corps Veteran of 8 years, and I will not have some woman who proclaims the evil of an inanimate object, yet carries one, tell me I may not have one.

On January 2, Vanity Fair ran an all-out attack on the constitution, the 2nd Amendment, and common sense in a column by Kurt Eichenwald titled, "Let's Repeal the Second Amendment."
Eichenwald's approach consists of attacking the NRA, arguing that gun owners avoid discussing more gun control by saying they don't want to "politicize" shootings, and taking the standard progressive position that there wasn't really a right to keep and bear arms until Justice Antonin Scalia created one in recent Supreme Court decisions.

Well, another vendor has joined the ranks of those that fail to completely honor the Second Amendment.
Dana Safety Supply has stated that they will no longer sell self loading rifles to civilians and will reserve those rifles for sale only to law enforcement agencies.

According to the FBI annual crime statistics, the number of murders committed annually with hammers and clubs far outnumbers the number of murders committed with a rifle.
This is an interesting fact, particularly amid the Democrats' feverish push to ban many different rifles, ostensibly to keep us safe of course.

A Montgomery County elementary school student was suspended for a pretend gunshot a week after Adam Lanza killed 20 children and six adults at Sandy Hook Elementary School in Newtown, Conn.
The 6-year-old, who attends Roscoe R. Nix Elementary School in Silver Spring, made a gun with his hands, pointed it at another student and said "pow," according to Robin Ficker, the boy's attorney. He was given a one-day suspension, with a conference on the matter planned for Jan. 2, the day students return to school from winter break.

Backers of laws that let pretty much all law-abiding carry concealed guns in public places often argue that these laws will sometimes enable people to stop mass shootings.
Opponents occasionally ask: If that’s so, what examples can one give of civilians armed with guns stopping such shootings? Sometimes, I hear people asking if even one such example can be found, or saying that they haven’t heard even one such example.

Does the Wounded Warrior Project (WWP) have a bias against guns and gun makers?
Two weeks ago that would have sounded crazy, but this week many shooters are convinced that it’s true. Hundreds of hunts and shoots are held as fundraisers for the WWP, and gun companies donate to WWP for its projects. How could it be that this $185 million (2013 projected revenue) outfit could be anti-gun?

NBC fails once again to recapture its long lost, sports-minded audience. Sunday Night Football is watched by avid football fans who don’t give a damn about reality TV shows or political speeches. NBC interrupted its half-time football telecast to bring sports fans a 90-second gun control rant from Bob Costas. The network-sponsored assault on 2nd Amendment rights, like most of NBC’s programming, misses its target audience by a mile. A 12-year-old girl took matters into her own hands during a home invasion in southeast Oklahoma.
It happened on Wednesday when the girl was home alone. She told police a stranger rang the doorbell, then went around to the back door and kicked it in. She called her mom, Debra St. Clair, who told her to get the family gun, hide in a closet and call 911.

There is a big change in enforcement of restrictive firearms laws in one Illinois county.
Illinois' McLean County State’s Attorney, Ronald C. Dozier, has taken a stand against enforcing certain Draconian Illinois gun laws. Announcing in his press release, with certain exceptions, the McLean County State’s Attorney’s Office, “Will no longer enforce those parts of the following Illinois statutes relating to firearms:
Firearm Owners Identification Card Act (430 ILCS 65),
Unlawful Use of Weapons (720 ILCS 5/24-1),
Aggravated Unlawful Use of Weapons (720 ILCS 5/24-1.6)
and provisions of any other statutes that appear to be in contravention of the Heller and McDonald decisions.”

“Two dead and nine wounded in rampage shooting,” we were told.
And these reports about the “mass shooting” almost always included some reference to this “latest mass shooting,” rekindling the debate over gun laws in our country. Even after it became apparent that the “gunman” had probably shot only one person, a former employer who he had threatened a year earlier – and that the rest of the victims were shot by police – the news stories and pundits continued to refer to this “latest mass shooting” and postulating on how politicians would or should respond.

An Alabama woman said she was forced to shoot an intruder that broke into her home this week in order to protect herself and her daughters.
Martha Lewis of Dora, Ala. told WVTM-TV it was about 3 a.m. Tuesday morning when she heard a loud noise, which turned out to be someone kicking in her door. Lewis said she called the police and grabbed her gun, then went to her daughters’ room and told them each to get something to defend themselves with. She said one grabbed an ax and one got a butcher knife.

WASHINGTON – A bipartisan group of 51 senators is threatening to oppose a global treaty regulating international weapons trade if it falls short in protecting the constitutional right to bear arms, as the United Nations bumps up against a Friday deadline for action.
In a letter to President Obama and Secretary of State Hillary Clinton, the senators expressed serious concerns with the draft treaty that has circulated at the United Nations, saying that it signals an expansion of gun control that would be unacceptable.

While this past weekend’s shooting in Aurora, Colorado got a lot of national attention, a previous shooting, which took place in April and virtually no one heard about it. On April 22, 2012 convicted felon Kiarron Parker, just released from jail, entered the parking lot of an Aurora, Colorado church and shot and killed one of the members of the congregation before being killed himself by a member carrying concealed.

Samuel Williams could soon become a poster child for concealed carry. Or rather a poster senior citizen.
Williams is being hailed as a hero this week after he sprung into action on Friday to thwart an armed robbery at an internet cafe. Williams was present when two masked thugs walked into the Palms Internet Cafe in Marion County, Florida. One of the men was brandishing a gun while the other had a bat. They started ordering patrons around and one smashes a computer screen. That’s when Williams took action.

President Obama has granted an 11th-hour request by Attorney General Eric Holder to exert executive privilege over Fast and Furious documents, a last-minute maneuver that appears unlikely to head off a contempt vote against Holder by Republicans in the House.
The House Oversight and Government Reform Committee is expected to forge ahead Wednesday morning with its meeting on the contempt resolution anyway.

As an elected district attorney, Christian Gossett is one of the few people Wisconsin's concealed carry law specifically allows to wear a weapon in a courthouse.

Audio of Reverend Jesse Jackson speaking in Racine, Wisconsin was posted on YouTube Monday, where the activist describes a march on gun shops throughout the country happening this summer.
While Jackson can be difficult to understand on a good day, the audio recorded from the crowd is even harder to comprehend at times. Gurminder Parmar and his wife have been the victims of robberies before. In fact, Parmar’s wife says their little mom-and-pop convenience store has been getting robbed a lot lately — almost weekly — and some have even used guns. This time, he had some good ideas, although he remains wedded to many bad ones, too. A polite guest, Mr. Calderon did not mention the “Fast and Furious” operation during his public events with President Obama. But reports indicate that he did bring it up privately, and he was furious - justifiably so. According to Mexico’s attorney general, those firearms have been used in 200 homicides in Mexico. Another victim was U.S. Border Patrol Agent Brian Terry, killed in December 2010.

With hundreds of applications flowing in every day, the Department of Justice last week issued the 100,000th concealed carry permit in the state since the law passed last year, Attorney General J.B. Van Hollen announced Friday.

Mitt Romney drew a warm reception from the National Rifle Assn. on Friday as he attacked President Obama for “employing every imaginable ruse and ploy” to restrict gun rights, which Romney pledged not to do if elected in November.

A state permit to carry a concealed firearm would be valid in almost every other state in the country under legislation the House passed Wednesday.
The first pro-gun bill the House has taken up this year and the first since Rep. Gabrielle Giffords, D-Ariz., was severely injured in a gun attack in January, it had the National Rifle Association’s backing and passed by a comfortable margin. The vote was 272-154, with only seven Republicans voting against it and 43 Democrats supporting it.

This interesting bit of news was reported in an April 11 Washington Post Lifestyle section story about Obama's gun-control and regulatory policy wonk Steve Croley. Toward the end of the article the writer, Jason Horowitz, mentions a March 30 meeting between Jim and Sarah Brady and White House Press Secretary Jay Carney during which the President "dropped in."

The Colt revolver, a historic remnant from the shoot-em-up days of the old West, is now Arizona's official gun.
Jan Brewer, the Arizona governor, on Thursday signed a bill into law that makes the Colt Single Action Army Revolver the state’s firearm, making Arizona only the second in the nation to have such a designation.
The Colt revolver, made popular in the 1800s, was a common weapon carried by the likes of Bat Masterson, Buffalo Bill Cody and Wild Bill Hickok, according to “The Book of Colt Firearms”, by R. L. Wilson.
Production first ran from 1872 through 1941 and then again from 1955.
Opponents said the designation was ill-timed, coming as the state deals with the fallout from a massive budget crisis and only months after a mass shooting in Tucson.
A Navajo Nation lawmaker also strongly objected to honouring a gun that killed his people and so many others during its long history in the American West.

Right now, Washington is scheming and scamming to erode then erase the Second Amendment from our Constitution. And it will accomplish it through the signing of international treaties on gun control, bypassing the normal legislative process in Congress, tightening regulations upon firearm and ammunition manufacturers, using the antigun financing of tycoons and ultimately confiscating all firearms under the guise of terrorism patrol and enforcement.
Without public debate and cloaked in secrecy, gun control will covertly come upon us like a thief in the night. One day, we will wake up to discover that the U.S. has signed a global treaty that will prohibit any transfer of firearm ownership, force reductions in the number of firearms privately owned and eventually eradicate the planet of guns for law-abiding citizens. Of course, the criminals will still illegally have their guns. And on that day, if you do not comply with that global treaty, you will be fined and face imprisonment. This is not a fictitious story or false warning. As sure as government health care has been shoved down our throats, so will the barrels of our guns. And left with little defense, we will go as lambs to the slaughter.
I believe the political stars are aligning right now for just such a "perfect storm" of domestic disarmament: via the election and work of an antigun president, the disarmament passions of the Washington elites and the United Nations, the appointments of gun prohibitionists from the White House to the Supreme Court, and the funding of an anti–Second Amendment movement by billionaire progressives like George Soros.
This is the evidence – the smoking gun, if you will – of the pressing threat to the Second Amendment and our firearm freedoms.
As Wayne LaPierre, executive vice president of the National Rifle Association, wrote in the American Rifleman (February 2010): "President Obama's political mantra of 'hope and change' has morphed into a very real threat. Obama's deep curtsy to international arms control has given 'hope' to the international gun-ban crowd that they will prevail."
It was no surprise when Obama was elected that the nation was consumed with other domestic issues and had selected a president with one of the most anti-firearm records in American history. During his presidential campaign, the National Rifle Association outlined more than two dozen ways that Obama has fought against America's Second Amendment firearm freedoms over the years. So much so, that the NRA graded Obama's (and Hillary Clinton's) voting records among other presidential candidates as an "F." (Does that give any freedom-loving firearm bearer any hope now that both are now part of the same administration?) No wonder a Gallup poll in October 2009 revealed that 41 percent of all Americans and 52 percent of gun owners believe that Obama will try eventually to ban the sale of guns.
It was also no surprise, therefore, a year ago this month when Obama personally promised Mexican President Felipe Calderon that the White House would push to ratify through the Senate the CIFTA (the Inter-American Convention Against Illicit Manufacturing of and Trafficking in Firearms) treaty, which has sat tabled and unapproved by the U.S. Senate since 1997.
But then, as quickly as he initiated the debate, the president just as quickly ceased trying to ratify CIFTA in the U.S. Senate. Why was that? Cato Institute scholar Ted Galen Carpenter said there was a reason that the treaty was tabled a year ago by Obama. I agree. I believe that reason was Obamacare. He knew he couldn't tackle and force through Congress two incredibly hot and volatile issues at once, at least of this caliber. But now that Obamacare is law, it's no surprise that both CIFTA and a separate U.N. small-arms treaty are experiencing a renewed life. And like Obamacare was pitched solely under "health-care reform," you can bet that a small-arms weapon ban will be pitched under "a fight against global terrorism and drug wars."
Trust me that what sounds like a tool being used against terrorism or illegal arm trade will actually further restrict Americans' right to bear arms. Under the disguise of an effort to combat drug violence, the passage of CIFTA or its equal will further clamp down upon our Second Amendment freedoms.
Again, as Wayne LaPierre, executive vice president of the National Rifle Association, summarized in the American Rifleman (February 2010): "The administration is trying to act as though this is really just a treaty about international trade between nations, but there's no doubt … that the real agenda here is domestic firearms control."
NRA might mean National Rifle Association, but it also means to me, "Never Remove (your) Arms." The fact is, the Second Amendment could even save your life.
That was the case this past year for Vern Grant, a 75-year-old Army veteran with Parkinson's disease and diabetes, who had just suffered through the death of his wife. Two weeks later, Vern was attacked by a burglar in his Washington home. After smashing the windows of Vern's handicap van and scavenging through his medicines, the intruder broke the glass of his back door and entered his home. Vern says the intruder was incoherently screaming.
The intruder nearly killed Vern after hitting him in the head. But Vern was able to grab and fire his gun in self-defense, hitting the suspect. Vern miraculously made it to his neighbor's house, where he sought help.
The suspect was airlifted to a hospital with non-life-threatening injuries, and Vern was released from the hospital after his head wounds were treated.
Grateful for his life and the Second Amendment, Vern asked a question to a reporter that we all should easily answer, "You'd do the same if you thought he was going to kill you, wouldn't you?"
Yes I would, Vern. In fact, by way of fair warning for any would-be burglars that break into my house, I hope they read the sign on my front porch first: "We don't dial 9-1-1 here."

(CNN) -- This time it was the intruder who called 911.
A man who broke into a house in Portland, Oregon, called police -- afraid the homeowner may have a gun.
The suspect, Timothy James Chapek, was in the bathroom taking a shower when the homeowner returned to the house Monday night, Portland police said in a statement.
Accompanied by two German shepherds, the homeowner asked Chapek what he was doing in the house.
Chapek locked himself in the bathroom and made an emergency call, police said. He said he had broken into the house, the owner had come home, and that he was concerned the owner might have a gun.
The homeowner also called the police to report that he had found a man in the house.
Police with dogs took Chapek, 24, into custody "without incident," they said. He was booked for criminal trespass.
They did not say if the homeowner did in fact have a gun.

At the end of the town hall meeting Saturday morning, one of the shooting victims, J. Eric Fuller, took exception to comments by two of the speakers: Ariz. state Rep. Terri Proud, a Dist. 26 Republican, and Tucson Tea Party spokesman Trent Humphries.

Arizona is one of the most gun-friendly states in the union, causing some on the left to conclude that if the Grand Canyon State had tighter controls on gun ownership, six lives would have been saved and Representative Gabrielle Giffords wouldn’t be lying in a hospital bed. There’s more here than just the usual sort of Monday morning quarterbacking that occurs whenever a tragic event touches the nation’s heart. Gun control advocates have suffered defeat after defeat and the majority of the nation today clearly supports the right of private citizens to bear arms and to defend themselves, their loved ones and their property. House Democrats have offered to exempt the National Rifle Association from a sweeping campaign-finance bill, removing a major obstacle in the push to roll back the Supreme Court’s Citizens United ruling.
The NRA had objected to some of the strict financial disclosure provisions that Democrats have proposed for corporations and politically active nonprofits and that had kept moderate, pro-gun Democrats from backing the legislation.
But if the NRA signs off on the deal, the bill could come to the House floor as early as this week. The NRA said it would not comment until specific legislative language is revealed.

In a recent ruling regarding the “transfer” of firearms, the Bureau of Alcohol, Tobacco and Firearms (BATFE) has reversed policies that have been in place for more than 40 years.
In the ruling, BATFE declared that a temporary shipment of a firearm by a federal firearms licensee to a non-employee for business reasons (such as a manufacturer's shipment to a gun writer or engineering consultant for a technical evaluation), will now be considered a “transfer” and require completion of a Form 4473 and background check.

This international agreement poses real risks for freedom both in the United States and around the world by making it more difficult - if not outright illegal - for law-abiding citizens to keep and bear arms.
The U.N. claims that guns used in armed conflicts cause 300,000 deaths worldwide every year, an inordinate number of which are the result of internal civil strife within individual nations. The solution proposed by transnationalists to keep rebels from getting guns is to make the global pool of weapons smaller through government action. According to recent deliberations regarding the treaty, signatory countries would be required to "prevent, combat and eradicate" various classes of guns to undermine "the illicit trade in small arms." Such a plan would necessarily lead to confiscation of personal firearms.
