In order to protect our religious liberties from unwarranted and unprecedented government intrusion, the Archdiocese of New York has filed suit in federal court today seeking to block the recent Health and Human Services mandate that unconstitutionally attempts to define the nature of the Church’s religious ministry and would force religious employers to violate their consciences. The Diocese of Rockville Centre has joined in the lawsuit.

A federal judge temporarily blocked enforcement of a part of the National Defense Authorization Act that opponents claim could subject them to indefinite military detention for activities including news reporting and political activism.
U.S. District Judge Katherine Forrest in Manhattan today ruled in favor of a group of writers and activists who sued President Barack Obama, Defense Secretary Leon Panetta and the Defense Department, claiming a provision of the act, signed into law Dec. 31, puts them in fear that they could be arrested and held by U.S. armed forces.

The Obama administration said Monday that it would appeal a federal judge’s ruling that the Environmental Protection Agency illegally vetoed a major coal mining project in West Virginia.
In a scathing decision in March, the United States District Court judge, Amy Berman Jackson, wrote that the E.P.A.’s unilateral decision in January 2011 to retroactively revoke the waste disposal permit for the Spruce No. 1 mine in Logan County, W.Va., overstepped the agency’s authority. Her ruling paved the way for the mountaintop removal mining project covering 2,278 acres to go forward.

(Reuters) - The Justice Department sued the city of Jacksonville, Florida, on Monday, claiming its use of written tests to determine promotions in the city's fire department discriminates against African-Americans.
The lawsuit followed a more than two-year investigation examining Jacksonville's record of promoting African-Americans for the ranks of lieutenant, captain, district chief and engineer dating back to 2004.

State and local resistance to the detention provisions contained in the National Defense Authorization Act continues to grow, rapidly emerging as a nationwide movement.
The Tennessee legislature will consider HB1629 and SB2669 in the 2012 session. The legislation would effectively nullify the detention provisions in the NDAA and would also require federal agents making an arrest in the Volunteer State for any reason to first obtain written permission from the county sheriff.

(CBS News) In the escalating battle between the administration and the judiciary, a federal appeals court apparently is calling the president's bluff -- ordering the Justice Department to answer by Thursday whether the Obama Administration believes that the courts have the right to strike down a federal law, according to a lawyer who was in the courtroom.
The order, by a three-judge panel of the U.S. Court of Appeals for the 5th Circuit, appears to be in direct response to the president's comments yesterday about the Supreme Court's review of the health care law. Mr. Obama all but threw down the gauntlet with the justices, saying he was "confident" the Court would not "take what would be an unprecedented, extraordinary step of overturning a law that was passed by a strong majority of a democratically elected Congress."

SALISBURY — The ACLU asked Rowan County Commissioners this week to stop opening their meetings with religion-specific prayers to comply with a recent court ruling.

To all my friends in battle,
The Judge pulled the lawyers for the three cases into chambers before it all began and advised them that he would be issuing a default judgment in our favor, since the Defense council failed to show, and wanted to end it there. We argued that all the evidence needed to be entered in to record so the Judge allowed for a speedy hearing where all evidence was entered into the court record. What that means is this… Any appeal, if one is even possible, would be based on the evidence provided by the lawyers in each case. Both Van Irion and My lawyer, Mark Hatfield made certain that our cases and evidence in those two cases would be closed so as not to be affiliated, in any way, with “Birther” Orly Taitz. As expected, she was an embarrassment.
Now we’re merely awaiting the publishing of this Judge’s ruling which, as previously stated, will be a Default Judgment.
In other words…we won. Now it’s time for the rest of the States to take my lead and duplicate this effort.

WASHINGTON (AP) — The D.C. Council is considering legislation that would make it easier for gay and lesbian couples who marry in the nation’s capital to get divorced.
The bill would let gay couples who married in Washington get divorced even if they no longer live in the district, provided they live somewhere that would not recognize their divorce. Under current law, one member of the divorcing couple has to live in Washington for six months before starting divorce proceedings.

Livingston County, NY – Judge Robert Wiggins dealt a major setback to New York Governor Cuomo and Mayor Bloomberg in the lawsuit brought by Liberty Counsel against the same-sex marriage law (“Act”). In response to the flagrant violations of the New York state constitutional and legal procedures, Liberty Counsel filed suit in the New York Supreme Court against the Act, which was signed into law on June 24, 2011, by Gov. Cuomo. The state asked the court to dismiss the case, but yesterday afternoon, Judge Wiggins sided with Liberty Counsel on the Open Meetings complaint, ruling that the case may proceed to trial. Liberty Counsel represents New Yorkers for Constitutional Freedoms and several other plaintiffs.

Yvonne Gonzalez Rogers, an Alameda County judge since 2008, was confirmed by the Senate on Tuesday for the U.S. District Court in Oakland, where she will become the first Latina federal judge in the Bay Area.
The Senate voted 89-6 to approve President Obama's nomination of Gonzalez Rogers to fill the vacancy created by U.S. District Judge Vaughn Walker's retirement in February. In January, Ohioan Kelley Williams-Bolar was sentenced to 10 days in jail, three years of probation, and 80 hours of community service for having her children attend schools outside her district. Gov. John Kasich reduced her sentence last month.
Ms. Williams-Bolar caught a break last month when Ohio Gov. John Kasich granted her clemency, reducing her charges to misdemeanors from felonies. His decision allows her to pursue her teacher's license, and it may provide hope to parents beyond the Buckeye State. In the last year, parents in Connecticut, Kentucky and Missouri have all been arrested—and await sentencing—for enrolling their children in better public schools outside of their districts.

A long-anticipated decision has finally been handed down by the Fifth U.S. Circuit Court of Appeals in the infamous "candy cane" case.
The court ruled yesterday that the Plano (Texas) Independent School District violated the Constitution by not allowing student Jonathan Morgan to hand out candy cane pens with a religious message at his class "winter" party nine years ago. According to the ruling, a little girl who was threatened for handing out tickets to a religious play, as well as an entire class of children who were forbidden from writing "Merry Christmas" on holiday cards to American troops overseas, also suffered discrimination.

Sarah Palin’s family attorney John Tiemessen has written a letter to Maya Mavjee, the publisher of the Crown Publishing Group, a division of Random House, that Palin may sue her, the company, and the book’s author Joe McGinniss “for knowingly publishing false statements” in his book released last week, “The Rogue,” ABC News has learned.

A federal judge has ordered the Secret Service to release eight months of White House visitor logs it had previously kept hidden, an estimated "tens of thousands" of records from Obama's first year in office.

At the request of tea party leaders in Arizona, famed Maricopa County Sheriff Joe Arpaio has promised to investigate the validity of Barack Obama's purported long-form birth certificate in a determination of the president's eligibility for the county's 2012 election ballot.
Tea party leaders in Surprise, Ariz., met with Arpaio and WND senior reporter Jerome Corsi Thursday morning to express concern that a fake birth certificate would be used to document the president's eligibility to run in Maricopa County, where Arpaio is the chief law enforcement officer.

Wow! It’s really flattering that radio talk-show host Thom Hartmann is attributing the Concord Project with the Tea Party taking over the GOP. The fact is, though, the GOP is still filled with those who would compromise the Constitution and bankrupt our country. 1. The Unenforced Definition of “Natural-Born Citizenship”
The U.S. Constitution requires that a presidential candidate be a natural-born citizen in order to be eligible for the office of President.
In seeking to define the meaning of “natural born citizenship”, those who blindly support Obama desperately seek a minimalist’s definition of the term. They desire that a natural-born citizen is one to whom may be ascribed as few requirements as possible in order that a candidate, with whom they share ideological fetishes, can be president regardless of his actual fitness for the office. They seek to assume jurisdiction over the declaration of being “natural born” in the minds of as many as possible while contending that “natural born citizenship” means the fewest, most remedial natal circumstances possible, which will allow their politigod, Barack Obama, just enough legitimacy to squeak by and be eligible.
Their definition allows Obama to merely meet what they consider the most easily argued, though obviously unverifiable characteristics of Obama’s obscure citizenry, in this case, his birth place.
However, unfortunately for Obama supporters, the purposed intent of our founders was not so slight in this matter. They sought to make the meaning of being a natural born citizen the highest, most laudable position of all forms of citizenry. After witnessing the corruption and inbreeding and treasons of monarchal rule, America’s founders desired that becoming President of the United States to be as difficult as possible…politically, socially and biologically.

On July 12, 2011 4 brave individuals filed a lawsuit against the NY Board Of Elections, NY Republican, & NY Democratic Parties.
An injunction was filed on the same day which required all 62 counties in the state of NY to accept Petitions with the Committeeman title. The lawsuit and injunction could not have come at a better time. For example, on July 13 several Monroe Tea Party folks were denied their petitions because they had the “wrong title and the positions were already filled” according to Orange County Board of Elections Commissioners.

The American Civil Liberties Union has pledged to file a lawsuit against the recently passed Alabama immigration law, according to the Los Angeles Times. The ACLU has slammed the law as being “draconian” and unconstitutional. The law is similar to the controversial Arizona immigration bill from last year, SB 1070, in that law enforcement officers have to check the citizenship status of any person they suspect of being an illegal immigrant.

Arizona Judge Roland Steinle has just sentenced Faleh Almaleki to 34½ years in prison. According to live reporting from the courtroom, the judge noted that Almaleki showed no remorse after the murder, that he did not forgive his daughter, that he did what suited his own purpose. The judge also said this was the hardest case he had to face in his six years on the bench. He found no mitigating factors and sentenced Almaleki to 34 and 1/2 years: 15 years for the aggravated assault of Khalaf, 3 and 1/2 years for leaving the scene of an accident, and 16 years for the second-degree murder of his daughter. He was facing a maximum total of 46 years.

Immigration and Customs Enforcement has agreed to begin providing medical care that goes well beyond emergency treatment, as a result of a lawsuit filed by the ACLU. This went beyond the usual objections to particular policies. It was the fact that policies were crammed down our throats, whether we liked them or not. In a new twist in the fight over Arizona’s immigration law, Republican Gov. Jan Brewer on Tuesday asked a federal court to disallow foreign governments from joining the U.S. Department of Justice lawsuit to overturn the law.
The move comes in response to a 9th Circuit Court of Appeals ruling issued Monday, allowing nearly a dozen Latin American countries — Mexico, Argentina, Bolivia, Brazil, Costa Rica, Ecuador, El Salvador, Nicaragua, Paraguay, Peru and Chile — to submit friend-of-the-court briefs in Justice’s challenge to SB 1070, which Brewer signed into law in April and is considered one of the nation’s toughest immigration-enforcement measures.

A coalition of Mexican mayors has asked the United States to stop deporting illegal immigrants who have been convicted of serious crimes in the U.S. to Mexican border cities, saying the deportations are contributing to Mexican border violence.

It’s really irrelevant where Obama was born, he’s still not a “natural born” citizen and is constitutionally ineligible to hold the office of President of the United States, if, in fact, Obama’s father was who Obama claims.
If Obama’s father was Barack Hussein Obama, a foreign national who was only attending college on a student visa and was never a resident of the United States, Obama II, at birth, would be a dual citizen at best, and constitutionally ineligible to hold office.

DETROIT, MI–The Law Offices of Debbie Schlussel, a Detroit-area law firm, today, announced the filing of a federal lawsuit against Imad Fadlallah, the Muslim man who was, until July, the principal of Dearborn’s Fordson High School, a tax-funded public high school, the student body of which is overwhelmingly Muslim (more than 90%). The suit is also against Fadlallah’s employer at all times relevant to the actions referred to in the suit, the Dearborn Public Schools, which, as noted in the complaint, was aware of the behavior alleged in the suit. As stated in the lawsuit, the action filed by Schlussel’s clients, Bryan Purcell and Georgene Stergalas, concerns the continued harassment of them by Fadlallah and other school personnel because they are Christian and not Muslim or of Arabic heritage. The suit was filed in the United States District Court for the Eastern District of Michigan.

Having worked with Elena Kagan at the Clinton White House, Dick was inclined to see her as a political moderate, worthy of support as the best one could expect from the Obama White House. But no more.

A New Orleans judge on Tuesday blocked the six-month ban imposed in the wake of the Gulf oil spill, saying the Interior Department had failed to provide adequate reasons for it.

A New Orleans federal judge lifted the six-month moratorium on deepwater drilling imposed by President Barack Obama following the largest oil spill in U.S. history. Drilling services shares jumped on the news.
Obama temporarily halted all drilling in waters deeper than 500 feet on May 27 to give a presidential commission time to study improvements in the safety of offshore operations. More than a dozen Louisiana offshore service and supply companies sued U.S. regulators to lift the ban. The U.S. said it will appeal the decision.

Putting aside real wars in Afghanistan and Iraq, there's the battle against leaking oil in the Gulf, the struggle against 9.7 percent unemployment across the country, and clashes over the president's agenda on Capitol Hill. Despite all that, the White House has found time to issue a new declaration of war, this time against an unlikely enemy: the state of Arizona.

Elena Kagan has kept her cards so close to the vest that in the days after President Obama nominated her to the Supreme Court, some on the left worried she was too moderate to replace liberal Justice John Paul Stevens.
But in documents obtained by CBS News, Kagan--while working as a law clerk to the late Justice Thurgood Marshall - made her positions clear on some of the nation's most contentious social issues.
The documents, buried in Marshall's papers in the Library of Congress, show Kagan standing shoulder-to-shoulder with the liberal left, at a time when the Rehnquist Supreme Court was moving to the conservative right.
They also provide a remarkably candid picture of her opinions, including on the most controversial issue Supreme Court nominees ever confront: abortion.
Although Kagan's confirmation has thus far been an all but foregone conclusion, sources say these documents will give Republicans a few cards of their own to mount a strong fight against her.

Arizona Governor Jan Brewer is still defending her state's controversial new immigration law, and said last night that she is prepared to face any legal charges brought up against it.
"We'll meet you in court," Brewer told CNN's John King when asked what she would do if the Justice Department decided to file suit against the law. She added, "I have a pretty good record in court."

Who the hell does Barack Obama, this morally preening, arrogant hypocrite, think he is? His vacuous, demagogic shtick about helping the "people" fight "the powerful" is getting so old from his lips, and already was so hackneyed even before he expropriated it, that it's a miracle that even he himself can say it anymore without getting nauseated by his own oleaginous triteness.
Obama spewed the same old effluvia Monday when introducing Elena Kagan as his nominee for the Supreme Court. Let us count the inanities and dishonesties in his introductory remarks:
"Behind law there are stories -- stories of people's lives as shaped by the law, stories of people's lives as might be changed by the law…" Of course, here he is quoting Kagan herself, but it's still absurd. Of course the law affects people's lives: That's why we have elections to choose legislators to write the laws, and it's why we give trial judges at least a modicum of discretion in meting out sentences when laws are violated. But even that discretion is governed by the laws as laid out by the legislative process. The appeals courts exist to ensure that those laws are applied the same way to every litigant regardless of what their personal stories are, not because of their personal stories.

Kagan's views on presidential control of regulation seem to echo those of controversial regulatory "czar" Cass Sunstein, who went so far as to argue the interpretation of federal law should be made not by judges but by the beliefs and commitments of the U.S. president and those around him, WND reported.
